In an interview with Buzz ng Bayan which aired on Sunday, Atty. Mallonga said that she's not buying the alibi of Atty. Virgilio Batalla, Cabanero's lawyer, who said that they did not specify a date in Roxanne's complaint affidavit.
"Tingin ko, napako sila. May lumabas na mga ebidensya. Ngayon, nag-aadjust sila. Pero huwag mo sasabihin na 'yung reklamo nila, puwedeng anytime from April 24 to 27. Hindi 'yun totoo. Hindi kami bulag. Nabasa ko, hindi ako tanga, naintindihan ko ang nakalagay doon," she said.
In the complaint-affidavit, which was signed by Cabanero and Assistant City Prosecutor Richard Parras, it was specified that the alleged rape happened on "April 24, 2010 in Pasig City, near Astoria Hotel."
Atty. Virgilio Batalla earlier denied that his client's complaint-affidavit mentioned the specified date and said that the alleged rape incident happened anytime from April 24 to 27 in 2010. The change came after
Vice Ganda confirmed that on the specified date and time of alleged rape, Vhong Navarro was with him in a concert at Island Cove resort in Cavite.
According to Atty. Mallonga, the sudden change of statements is an indication that Roxanne Cabanero's camp is lying.
"Hindi ito biro. Nanumpa ka, napaka-espesifico mo sa oras, panahon at lugar. Ano 'to lokohan? Lumabas ka sa media, nag-iiyak ka, siniraan mo si Vhong, tapos ngayon 'ay sorry, nakalimutan ko, hindi iba pala, mali ang nasabi ko,'" said Atty. Mallonga.
Vhong Navarro's camp is now set to file libel and perjury cases against Roxanne Cabanero. They are also finalizing the same complaint against Deniece Cornejo, who also changed statements saying that she was raped twice (
